Recently, the Shanghai Environmental Exchange successfully completed the enforcement of Shanghai's first criminal incidental civil public interest lawsuit case for illegal logging accepted by the Shanghai Railway Transportation Court, which is also the first public interest litigation case in the city in which the plaintiff requested that the defendant be ordered to bear the cost of ecological restoration of the forest by purchasing carbon sinks.
In the early stage, the Shanghai Environmental Exchange introduced and explained to the judges handling the case in detail and explained the forestry carbon sink, as well as the purchase and cancellation of carbon sinks, helping the judges clarify the relevant concepts and processes. At the specific implementation level, after receiving the notice of assistance in enforcement of matters related to the purchase of certified forestry carbon sinks from the Shanghai Railway Transportation Court, the Shanghai Environmental Exchange carried out relevant work after determining the facts of the case, the applicable legal basis and the interpretation of relevant carbon-related professional terms in the law in accordance with the Interpretation of the Supreme People's Court on Several Issues Concerning the Application of Law in the Trial of Civil Dispute Cases over Forest Resources and other relevant legal documents through its own professional research and judgment. After understanding and communicating with the relevant entities in the carbon market holding the purchase target in this case, the Shanghai Environmental Exchange assisted the defendant in completing the signing of the target carbon sink subscription, confirming the cancellation of the target carbon sink, and other work links, and assisted the court in completing the enforcement work efficiently and successfully. In addition, Bin Hui, deputy general manager of Shanghai Environmental Exchange, was invited by Shanghai Radio and Television Station to interpret the relevant professional issues involved in the publicity report of this typical case.
Fulfilling the responsibility of forestry ecological restoration by subscribing to carbon sinks is an effective alternative way to restore ecological and environmental damage.
