The Interim Regulations on the Administration of Carbon Emission Trading (hereinafter referred to as the "Regulations") will come into force on May 1, 2024, which is China's first special administrative regulation on carbon emission trading. In order to do a good job in the publicity and implementation of the "Regulations", comprehensively and thoroughly implement the management requirements of carbon emission trading and related activities, strengthen the control of greenhouse gas emissions in Liaoning Province, further enhance the social influence of the "Regulations", and create a legal atmosphere of knowing and abiding by the law, Liaoning Province has formulated an implementation plan for the implementation of the "Regulations".
The plan proposes a number of specific work measures. The plan is clear, and the list of key emissions is determined in a timely manner. According to the scope of industries to be included in the verification coverage determined by the state, the list of enterprises participating in the verification of the next year shall be determined before December 15 of each year with reference to statistics, pollutant discharge permits and other data on the basis of the annual list of verification enterprises. According to the verification results, quota allocation plan and other conditions, the list of key emitting enterprises shall be determined and announced to the public。
In-depth implementation of supervision and assistance. The plan points out that power generation enterprises should be organized to conduct self-examination of annual carbon emission data, and all cities and Shenfu Demonstration Zone should carry out monthly on-site audits in a timely manner, find and solve problems in the annual emission report in advance, and report the problems in the self-inspection and audit process to the Provincial Department of Ecology and Environment before March 15. By the end of April, the technical training manual will be compiled, and the training of key enterprises will be carried out to improve the technical ability of enterprises to prepare emission reports. All cities and the Shenfu Demonstration Zone will provide one-to-one assistance to new enterprises, assist in connecting with advanced enterprises in the same industry in their jurisdictions, and improve their carbon emission data management capabilities. Before the end of June, focusing on private enterprises, we will carry out provincial-level carbon emission management supervision and assistance, and improve the quality management level of enterprise carbon emission data through assistance.
The plan points out that the organization will do a good job in the allocation of quotas and the payment and performance of key industries. According to the quota allocation plan, the quota allocation of key emitting enterprises shall be completed and issued in a timely manner。 Carry out inspections on the performance of key emitting enterprises。 Conduct investigations on the performance capacity and performance risks of compliance enterprises in key industries, carry out special assistance for key emitting enterprises with compliance gaps, and promote relevant key emitting enterprises to formulate trading plans as soon as possible to ensure that they perform on time and in full. Key emitting enterprises that fail to pay their quotas in full and on time shall be dealt with in accordance with the relevant provisions of the Regulations. In the elimination of backward coal-fired power capacity and the promotion of the "three reforms" of existing coal-fired power units, we will take into account quota loss-making enterprises, promote enterprises to reduce carbon emission intensity, and effectively improve their ability to perform the contract.
In order to improve the data quality supervision mechanism, the plan is clear, do a good job in daily supervision and management and annual emission report verification, further improve the longitudinal hierarchical supervision mechanism for enterprise self-inspection, municipal preliminary review, provincial review of monthly evidence storage and annual emission report preparation and review, timely discover and solve problems such as data anomalies and deficiencies, and urge enterprises to complete data quality rectification in a timely manner and complete quota payment on schedule. Regularly inspect the equipment and personnel of the technical service unit, the work process, and the management system. Evaluate the quality, compliance, and timeliness of the work of the verification technical service institutions, and help the technical service institutions improve their technical level.
