Policy interpretation of the Notice of the People's Government of Xining Municipality on Adjusting the Low Emission Control Area of Non-road Mobile Machinery in Xining City
The "Notice of the People's Government of Xining Municipality on Adjusting the Low Emission Control Area of Non-road Mobile Machinery in Xining City" (Ning Zheng [2024] No. 15), hereinafter referred to as the "Notice") policy is interpreted as follows.
1. Background and drafting process
In 2021, in accordance with the requirements of laws, regulations and rules such as the "Law of the People's Republic of China on the Prevention and Control of Air Pollution", the "Notice on Winning the Three-Year Action Plan for Winning the Blue Sky Defense War" (Guo Fa [2018] No. 22) and the "Implementation Plan for the Pollution Control of Diesel Trucks in Qinghai Province" (Qing Shengfa [2019] No. 113) and other laws, regulations and documents, our bureau will delineate the low-emission control area for non-road mobile machinery in the main urban area of our city. Notice of the Xining Municipal People's Government on Delineating Low Emission Control Areas for Non-road Mobile Machinery (Ning Zheng [2021] No. 25), which has been implemented since June 24, 2021. In order to further improve the ambient air quality of our city and reduce the emission of pollutants from non-road mobile machinery, according to the "Implementation Plan for the Elimination of Heavy Polluted Weather, Ozone Pollution Prevention and Control and Diesel Truck Pollution Control in Qinghai Province" (Qingshengfa [2023] No. 121) document requirements: Before the end of December 2023, Xining City and Haidong City will optimize and adjust the areas where the use of high-emission non-road mobile machinery is prohibited.
On the basis of the original demarcation of low-emission control areas for non-road mobile machinery in Xining, fully drawing on the governance experience of many large and medium-sized cities in China, and integrating various factors such as the city's geographical location, topography, environmentally sensitive areas and monitoring points, and environmental control requirements, the "Technical Report on the Optimization and Adjustment Plan of the Low-emission Control Area of Non-road Mobile Machinery in Xining City" was compiled and completed in November 2023, and passed the expert review. The "Optimization and Adjustment Plan for the Low Emission Control Area of Non-road Mobile Machinery in Xining City (Draft for Comments)" was drafted, and the opinions and suggestions of relevant regions and departments were solicited successively, and the revisions and improvements were made. On this basis, the "Notice on Adjusting the Low Emission Control Area of Non-road Mobile Machinery in Xining City (Discussion Draft)" was drafted, which passed the legality review of the Bureau of Justice and was approved by the 36th executive review of the municipal government, and was issued and implemented on February 27, 2024.
Second, the main content of the adjustment
This time, the scope of the second part of the original "Notice" is mainly optimized and adjusted, and the other parts have not been modified.
Following the existing environmental functional zoning, comprehensively considering the urban development planning, industrial layout and construction site distribution, taking into account the current situation of non-road mobile machinery supervision, and at the same time conducive to law enforcement and supervision, in the original "Notice" to add Datong County, Huangyuan County, Huangzhong District and some areas as non-road mobile machinery low emission control areas, the specific optimization and adjustment of the scope of the control area is as follows:
Huangzhong District:
Lushaer Town: A closed area surrounded by County Road 121, Tongning Road, Foguang Avenue and Heping Road.
Ganhetan Town: A closed area surrounded by Guangxin Avenue, Ganhe Avenue and Haixin Avenue.
Huangyuan County:
The closed area enclosed by Beijing-Tibet Expressway, Railway, Huangjia Highway, Xincheng Avenue, Railway Station Road, Chengbei Lane and Qinghai-Tibet Road.
Chase County Range:
It starts from the boundary of the low-emission control area in the north of the city in the south, and is a closed area enclosed by the roads of Ningda Expressway, Zhangwen Expressway, Jiaxi Expressway and Haihu Avenue Extension.
3. The significance of the issuance of the Circular
The issuance and implementation of the "Notice" will strengthen the supervision of non-road mobile machinery in the expansion area, reduce the emission of pollutants from non-road mobile machinery, and continue to improve the air quality of Xining City.
